Argentine Court Initiates Mistrial in Diego Maradona Death Investigation

A judge's involvement in a documentary surrounding Diego Maradona's case led to a mistrial, restarting the investigation of several medical professionals accused of negligence.

An Argentine court announced a mistrial on Thursday regarding the case of seven health professionals accused of negligence in the death of Diego Maradona, one of soccer’s greatest icons and a national hero in Argentina. The court’s decision follows the stepping down of Judge Julieta Makintach, who faced scrutiny for her role in a documentary about the case.

Judge Makintach withdrew on Tuesday amid backlash stemming from her significant involvement in the documentary “Divine Justice”. This film documents the aftermath of Maradona’s death in 2020 and the initial stages of the trial, prompting a one-week suspension of the proceedings when prosecutor Patricio Ferrari requested an examination of the event’s filming during trial sessions.

The mistrial resets the legal proceedings, voiding all actions taken since March 11. A higher court will appoint three new judges through a lottery system, with the timeline for the subsequent trial yet to be publicized.

The case revolves around the medical team managing Maradona’s health before his passing, with claims that they failed to provide sufficient care leading to his death from cardiac arrest following surgery for a blood clot in his brain. Among the defendants are Leopoldo Luque, the primary physician, in addition to a psychologist, psychiatrist, medical coordinator, and nurses—all of whom deny negligence, asserting that Maradona often resisted treatment.

Maradona participated in four FIFA World Cups, most notably steering Argentina to the 1986 title against West Germany. His unparalleled achievements in the sport have made him a global legend. Maradona was 60 when he died and is remembered as a preeminent figure in soccer history.
